Can dependants of a permit holder work?

Dependant status does not create work rights. A dependant who wants to work needs their own employer and their own work permit under the normal conditions. Family documents such as marriage and birth certificates usually need translation and legalisation for both immigration and labour filings.

Which comes first, the visa or the work permit?

In the usual sequence, the foreign national first holds a non-immigrant visa consistent with the intended employment, then applies for a work permit under the law on managing the employment of foreign workers, administered by the Department of Employment. Continued stay afterwards is decided separately by the Immigration Bureau. The three systems are distinct but interlocking, and a gap in one blocks the next.

Do I need a work permit for remote work for a foreign company?

This is fact-specific. The law addresses work performed within the Kingdom rather than only the location of the payer. Visas designed for remote workers carry their own conditions and do not automatically confer the right to work for a business in Thailand. Where Thai clients or a Thai entity become involved, obtain advice before starting to avoid regulatory exposure.

Can dependants of a work-permit holder work?

Permission to stay as a dependant and permission to work are separate matters. Dependants admitted on the basis of the principal's status do not gain an automatic right to work; they need an employer and their own work permit application under the normal criteria. Children entering school require a separate process, including certified translations of academic records.

Which authority decides a work permit, and what does it not cover?

The Department of Employment under the Ministry of Labour administers work authorisation for foreign nationals; the Immigration Bureau separately administers the right to stay. A work permit does not extend your permission to stay, and a valid visa does not authorise work. Both must be kept aligned, because expiry of one commonly triggers problems with the other at the next renewal.

What happens to the permit if I change employer or job title?

Authorisation is granted by reference to the employer, workplace and described duties, so a change in any of them normally requires a filing rather than a private arrangement. Continuing to work under the old permit after the change is treated as unauthorised work. Plan the change with the new employer before resigning, because the gap between employments also affects the underlying permission to stay.

What must be done when changing employer or job title?

A work permit is tied to the conditions recorded in it, including employer, position and place of work, so material changes must be notified or amended under the applicable law before working under the new conditions. Changing employer also usually affects employment-based permission to stay, so the two processes should be planned together. Typical documents are a letter from the new employer, corporate registration papers and the new employment contract; verify the current procedure with the Department of Employment.

Is a work permit the same as a visa in Thailand?

No. A visa such as Non-Immigrant B is issued by a Thai embassy or consulate, extensions of stay are approved by the Immigration Bureau, while the work permit itself is issued by the Department of Employment under the Emergency Decree on Managing the Work of Aliens B.E. 2560 (2017). Holding a valid visa does not by itself authorise employment, and working before authorisation carries legal penalties, so both tracks must be planned together.

What is the route for Thai company documents used abroad?

Obtain the company affidavit, shareholder list (BorJor 5) or latest memorandum from the Department of Business Development, translate into the language the destination requires, then legalise at the Legalization Division of the Department of Consular Affairs. If the destination is not an Apostille Convention party, the destination country's embassy certifies last.

Must the company affidavit be freshly issued?

Most receiving authorities set a validity window counted from the registrar's issue date, commonly measured in months. Check the recipient's requirement before ordering copies: filing an out-of-date affidavit is a frequent rejection cause, and legalisation cannot revive an expired document.

How is a corporate power of attorney certified?

An authorised director signs before a Notarial Services Attorney, attaching a current company affidavit that evidences signing authority. Before you start
  • Consider BOI when your activity is an eligible promoted activity

    A promotion certificate carries incentives and shareholding conditions that differ from an ordinary company. Compare minimum investment, technology and employment conditions per activity before committing.

  • Treat product and premises permits as separate from the business licence

    Company registration does not authorise sales. Food, cosmetics and medical devices require FDA Thailand registration, and production or storage premises are inspected separately.

  • Draft company objectives to cover, but not exceed, what you need

    Objectives registered with the Department of Business Development must cover the licensed activity. A mismatch forces an amendment of the affidavit first, typically costing weeks.

  • Legalise parent-company documents through the full chain

    Affidavits, financial statements and powers of attorney usually need notarisation abroad, government or embassy authentication, then Thai translation and legalisation by the Legalization Division, Department of Consular Affairs.

  • Foreign documents older than the accepted validity window

    Parent-company affidavits and powers of attorney often have a validity period from issue. A slow legalisation chain can expire them before filing, forcing a fresh set.

  • Assuming a BOI certificate covers every activity

    Incentives attach only to the promoted activity and its stated conditions. Revenue from non-promoted activities must be accounted for separately and taxed normally.

  • Using nominee Thai shareholders

    Holding shares on behalf of a foreigner without genuine investment breaches the Foreign Business Act, and the source of Thai shareholders' funds can be examined. We do not assist with such structures.

  • Signatory names not matching the latest affidavit

    If directors change mid-process, the affidavit and power of attorney must be updated to match, otherwise the application is rejected at intake.
