Cross-border power of attorney

Q&A on drafting and certifying a power of attorney for use in Thailand and abroad. — 3,920 questions in total (page 21/98)

How long does a divorce certificate take before it can be filed with UK authorities?

Three variables drive the timeline: the readiness of the original a divorce certificate, the certification queue at a Notarial Services Attorney, and the intake schedule of UK authorities. When the original is complete and no re-issue is required, drafting and certification usually run in working days, while government queues shift with filing season. We give you a realistic estimate once we have seen your documents, and we advise against booking flights or appointments before the papers are in hand. For the exact fee and turnaround for your case, please contact our staff by phone, LINE or email.

How long does a certified a divorce certificate stay valid for UK authorities?

The certification itself does not expire, but UK authorities usually requires civil-status documents to have been issued within a set window before filing (commonly 3 or 6 months). What counts is the issue date of the original a divorce certificate, not the certification date. If your filing date is still open, obtain the original as close to filing as possible and certify afterwards to avoid repeating the work. For the exact fee and turnaround for your case, please contact our staff by phone, LINE or email.

Into which language must a divorce certificate be translated, and who certifies the translation for UK authorities?

As a rule UK authorities accepts a translation into the official language of the receiving country, or English where the rules allow it. Who may certify differs by destination: a translator accredited in that country, a NAATI-certified translator for Australia, or a translation certified through a Notarial Services Attorney for Thai-issued papers. The translation of a divorce certificate must reproduce document numbers, seals and signatures, and mark illegible text as such rather than guessing. For the exact fee and turnaround for your case, please contact our staff by phone, LINE or email.

ยืนยันแหล่งอ้างอิงแล้ว

How many layers of authentication does a divorce certificate need before UK authorities accepts it?

The standard chain for Thai documents is: issuing office → certified translation → a Notarial Services Attorney → the embassy or consulate of the destination country, where still required. For a divorce certificate used with UK authorities, the number of layers depends on whether the destination is an Apostille state and what form it accepts. Thailand deposited its instrument of accession to the Apostille Convention on 30 June 2026 and the Convention enters into force for Thailand on 28 February 2027 (source: HCCH). During the transition, confirm with the receiving authority whether it already accepts an Apostille or still requires embassy legalisation. For the exact fee and turnaround for your case, please contact our staff by phone, LINE or email.

ยืนยันแหล่งอ้างอิงแล้ว

Why would UK authorities reject a divorce certificate, and how do you fix it?

Recurring causes: a name spelled differently from the passport, an original older than the window UK authorities allows, an uncertified photocopy, a translation that drops a seal or document number, and an authentication chain done out of order. The fix is always upstream — obtain a fresh a divorce certificate or have the issuing office correct the data, then repeat the chain. Never amend by hand: a Notarial Services Attorney will not certify a document altered outside the official process. For the exact fee and turnaround for your case, please contact our staff by phone, LINE or email.

ยืนยันแหล่งอ้างอิงแล้ว

Can a divorce certificate be handled for UK authorities while I am overseas, without returning to Thailand?

In most cases yes: sign a power of attorney before a Thai embassy or consulate officer where you live, or before a local notary followed by the required onward authentication. Then courier the original a divorce certificate and the power of attorney to us; we complete certification with a Notarial Services Attorney and send the file back to your address. The exception is any step where UK authorities requires the holder to appear in person, which we check case by case. For the exact fee and turnaround for your case, please contact our staff by phone, LINE or email.

ยืนยันแหล่งอ้างอิงแล้ว

My name on a divorce certificate differs from my passport — will UK authorities still accept it?

Align them before filing, because UK authorities treats the passport as the primary identity reference. Options: (1) ask the issuing office to correct a divorce certificate if it is a recording error; (2) obtain a same-person certificate and have it certified through a Notarial Services Attorney; or (3) use the passport spelling in the translation with a transliteration note. Which route is accepted varies by destination, so confirm before starting. For the exact fee and turnaround for your case, please contact our staff by phone, LINE or email.

ยืนยันแหล่งอ้างอิงแล้ว

Does UK authorities accept a scan or copy of a divorce certificate, or only the original?

Certification must always be based on the original a divorce certificate or a copy certified by the issuing office. Scans are fine for an initial assessment and for drafting the translation. For the actual filing, some UK authorities channels let you upload first and inspect originals at the appointment. The safe approach is to keep the original ready and to retain one spare certified set. For the exact fee and turnaround for your case, please contact our staff by phone, LINE or email.

ยืนยันแหล่งอ้างอิงแล้ว

I need a divorce certificate urgently this week for UK authorities — is that possible?

Sometimes, depending on whether the original a divorce certificate is already in hand and whether a Notarial Services Attorney is running an expedited channel that week. What speeds things up most: send photos of every page for a pre-check, tell us your exact UK authorities appointment date, and prepare the power of attorney in advance. If your deadline is not achievable we say so plainly rather than risk your appointment. For the exact fee and turnaround for your case, please contact our staff by phone, LINE or email.

ยืนยันแหล่งอ้างอิงแล้ว

I need several certified sets of a divorce certificate for UK authorities — how should I plan it?

Tell us the number of sets at the start, because adding sets later means running the whole chain again. We generally suggest one spare beyond what you need, since UK authorities usually keeps the filed set. If the documents will be used in more than one country, prepare separate sets per destination — the certification format at a Notarial Services Attorney and the translation requirements can differ. For the exact fee and turnaround for your case, please contact our staff by phone, LINE or email.

ยืนยันแหล่งอ้างอิงแล้ว

What drives the cost of handling a divorce certificate for UK authorities?

The main drivers are the page count and text density of a divorce certificate, the language pair, how many authentication layers UK authorities requires, the number of sets, urgency, and the official fees set by a Notarial Services Attorney. We do not publish prices on the site because cases genuinely differ and a generic figure would lead to wrong planning. For the exact fee and turnaround for your case, please contact our staff by phone, LINE or email.

ยืนยันแหล่งอ้างอิงแล้ว

How do I receive the certified a divorce certificate — can it be shipped upcountry or abroad?

You can collect at the office, meet at an agreed pick-up point, or have the file shipped with tracking, domestically or internationally. For overseas shipping use a tracked service and give a recipient name matching your ID, as some countries scrutinise inbound official documents. We always photograph the finished a divorce certificate set for your approval before dispatch, so you can verify it before it reaches UK authorities. For the exact fee and turnaround for your case, please contact our staff by phone, LINE or email.

Power of attorney — drafting, signing and certifying for use abroad

Answers on powers of attorney: drafting a clear scope of authority, stamp duty under the Revenue Code, signature certification by a Thai notarial services attorney under the Lawyers Council regulation B.E. 2551, and MFA legalization when the document will be used abroad. (23+ search topics covered)

How is a power of attorney signed abroad made usable in Thailand?

The cleanest route is signing before an officer at a Thai embassy or consulate-general. Otherwise it is executed before a competent certifying authority locally and passed up the legalisation chain, with a certified Thai translation where required.

What details must a Thai power of attorney contain to be accepted?

A workable instrument identifies the grantor and the attorney by full legal name and identity document number exactly as they appear on the passport or Thai ID, states the authorised acts specifically rather than in general terms, and where relevant identifies the asset, case, or account concerned. Many authorities require their own prescribed form, notably land, vehicle, and company registration offices. Signatures, the date, and witnesses must comply with the form used, and duty stamps are required in the cases set by law.

Can one power of attorney cover several unrelated transactions?

Technically yes, but in practice Thai offices often prefer a separate instrument per matter. Land offices, the Department of Business Development and banks each read the authority clause narrowly and may refuse an act they consider outside the wording. A broad omnibus document also raises risk for the grantor. The safer pattern is one instrument per transaction, with the acts, the property or company, and the agent's identity spelled out.

Who may sign as a witness on a Thai power of attorney?

Thai practice usually expects two witnesses of legal age who are not parties to the transaction and not the appointed agent. Some offices additionally require the witnesses' identification numbers on the form, and land transactions may require the witnesses to attend. Because the prescribed form differs by office, use the form that the receiving office publishes rather than a generic template.

How long is a power of attorney valid, and how is it revoked?

General law sets no fixed expiry, but many receiving offices apply an internal policy of accepting only recently executed instruments, so ask the recipient before you sign. Revocation is effected by written notice from the principal to the attorney and to any office relying on the document, and you should retain proof of that notice. Where the original passed through several layers of certification, notify those bodies as well where practicable.

Why is a power of attorney commonly rejected in Thailand?

Most rejections come from a scope of authority that does not match the actual transaction. Many authorities expect the specific act to be identified, for example the title deed number, company registration number or account number. Other causes are missing signatures or witnesses required by the prescribed form, and use of a form other than the one the authority currently publishes. Documents executed abroad must also be certified in the correct sequence before use in Thailand, so obtain the destination's form and conditions in writing before drafting.

Can I draft my own, or must I use an official form?

Some Thai offices — notably land and certain registry matters — mandate their own form. Where no form is mandated you may draft one, but confirm the wording with the receiving party before signing.

Who can certify my signature in Thailand?

A Thai lawyer registered as a notarial services attorney with the Lawyers Council under the B.E. 2551 regulation. You must sign in person before that lawyer with original identification. The certification covers the signing, not the truth of the contents.

Cross-border power of attorney — get the draft right first

A power of attorney used abroad must define its scope precisely and is usually signed before a certifying officer before entering the legalisation chain for the destination country.

Documents to prepare

  • A draft stating scope and duration clearly
  • Passports or ID of the grantor and the attorney-in-fact
  • Related asset or transaction records such as title deeds or account numbers
  • Company affidavit when granted by a legal entity
  • The destination authority's own form where one is prescribed
  • Translation into the required language

Step-by-step process

  1. 1. Draft and review the scope Specify the exact acts authorised to avoid an over-broad instrument.
  2. 2. Sign before a certifying officer A Notarial Services Attorney or consular officer, depending on the case.
  3. 3. Translate and certify the translation Into the destination language, under its accepted system.
  4. 4. Legalise Through consular legalisation and the destination step before dispatch.

Pitfalls and rejection causes

  • Overly broad scope can be refused abroad and exposes the grantor to risk.
  • Many authorities accept only their own template — check before drafting.
  • Instruments with no end date are rejected in some jurisdictions.
  • A pre-signed document cannot be certified afterwards.

Tips from our team

  • Use a bilingual single document to reduce interpretation disputes.
  • Name a substitute attorney for long-running transactions.
  • Have the destination review the draft before signing.

Prefer not to handle the queues yourself, or worried about a rejection? Send us photos of your documents for a free pre-check. We handle the full chain — obtaining certified copies, translation, certification and submission — and keep you updated at each step. Reach us on LINE, phone or email during business hours.

Timelines above are practical estimates from live casework and can change with each authority's policy; confirm with the receiving authority before booking travel. If you would rather not test routes by trial and error, our advisers can assess which route fits your case.

Advisory Service

We do not just process documents — we advise you through the whole case

Our team has worked on cross-border documents, certified translation and government liaison for over 15 years. Most rejections we see are not caused by missing paperwork but by choosing the wrong route on day one, so we always start with a case assessment.

Route assessment

We look at your destination, purpose and deadline, then tell you which certification route applies — and which steps you can skip.

Pre-submission review

Name spelling, consistency across documents, document age and translation format are checked before anything reaches a counter.

Timeline planning

We sequence the steps around your appointment or travel date and flag bottlenecks in advance.

Rejection recovery

We read the refusal reasons, identify the underlying cause, and plan a resubmission that answers what the authority asked for.

Practical Q&A

Practical questions · Near me / DIY / Required documents

Where can I find a notary public near me in Thailand?

Thailand has no US/UK-style notary public. The authorised signatory is a “Notarial Services Attorney” licensed by the Lawyers Council of Thailand under Royal Patronage, so the work must be done at a firm with such a licensed lawyer. Our main offices are Lat Phrao 95 (Bangkok), Khon Kaen and Udon Thani, with meeting points near BTS/MRT stations and city malls. Ask our team by phone, LINE or email for the most convenient point.

Can I notarise a document myself without a firm?

No. Only a lawyer holding the Lawyers Council notarial-services licence may certify. What you can prepare yourself is the paperwork: the correct original or true copy, and your ID. Signature certification requires you to sign in front of the attorney, so do not sign the document in advance.

Which documents do I need to bring for notarisation?

At minimum: (1) your original passport or Thai ID card; (2) the exact document version you will submit; (3) for company signatories, a company affidavit dated within the period your recipient accepts, plus the seal if used; (4) the destination country and receiving authority, because the wording of the certificate and any onward steps (for example whether MFA legalisation is needed afterwards) depend on the destination.

  • Separate civil from criminal tracks early

One dispute can raise both. They use different courts, procedures and standards of proof; choosing the wrong track wastes time and cost.

  • Check the limitation period first

Different claims carry different prescription periods under the Civil and Commercial Code. Knowing when the clock started dictates whether to negotiate, send a demand letter, or file immediately.

  • Consider mediation alongside litigation

Thai courts offer mediation before and during proceedings. A compromise agreement recorded by the court is enforceable and usually far faster than a full trial.

  • Plan enforcement before you file

Winning does not mean being paid. Assess the counterparty's assets and realistic enforcement options first to judge whether the case is worth pursuing.

Common reasons documents get rejected
  • Discussing the case publicly

Posting party details or allegations while proceedings are live can create separate defamation exposure and damage the underlying case.

  • Submitting uncertified translations

Translations used in court or before agencies must be certified by the translator, and in some cases legalised by the Department of Consular Affairs. Machine translations are commonly rejected.

  • Missing court deadlines or demand-letter periods

Filing deadlines and hearing dates are binding; default can lead to an ex parte judgment. Contact counsel as soon as any court document arrives.

  • Signing settlement documents without reading the Thai version

In practice the Thai text usually governs. Obtain an accurate translation and review any waiver of claims before signing.
