Can a document from the Ministry of Justice replace a court record?
No. Ministry departments and the courts issue different instruments for different purposes, and receiving authorities usually name the exact document they require. Substituting a similar-looking certificate is a common cause of rejection. Ask the recipient to identify the issuing body as well as the document title before ordering copies.
How are foreign-language documents filed with a Thai court?
They are filed with a Thai translation accompanied by the translator's certification. Documents executed abroad must first be certified in the country of origin and then by the Thai embassy or consulate-general there. The translation must cover every page, including seals, signatures and endorsements; translating only the parts thought to matter invites challenge. Check the receiving court's practice first, as certification details vary by case type.
What is needed to use a Thai divorce judgment abroad?
Normally the judgment plus a certificate of finality from the deciding court, a translation into the destination language, MFA legalisation and, where that country requires it, embassy attestation in Bangkok.
Is a foreign judgment automatically enforceable in Thailand?
No. Giving effect to a foreign judgment in Thailand follows Thai law, varies by the type of case and may require fresh proceedings in which the judgment serves as evidence. Discuss strategy with the lawyer handling the matter, and prepare a court-certified copy of the judgment together with a translation certified through the full chain.
How should legal terminology with no equivalent be translated?
It is rendered descriptively with the original Thai term retained in brackets, rather than replaced by the nearest foreign concept, which would misstate the legal effect. Case numbers, dates, party names, statutory references, stamps and layout are reproduced faithfully so that a reviewer can compare the translation line by line with the original.
How do I obtain court-certified copies of case documents?
A party or interested person files a request with the court hearing the case, identifying the case and the documents required and proving identity under the court's rules. Once the certified copies issue, they can be translated and legalised for overseas use. Request every page you will actually need in one application: returning later costs time and may require restarting the certification chain. Before leaving the court, confirm the certification stamp appears on each page.
Is a Thai custody order automatically effective abroad?
Not necessarily. Recognition of a foreign court order is governed by the destination country's own law. Some jurisdictions accept a properly legalised order directly, while others require recognition proceedings before it can be enforced. Ask a lawyer or the relevant authority in the destination country which form they need, then assemble the bundle accordingly. Assembling the wrong bundle means repeating the whole legalisation chain.
What is a certificate of finality and when is it needed?
It is a court-issued statement confirming that the case is final and no appeal is pending. Receiving offices commonly ask for it alongside the judgment — for registering a divorce granted by judgment, amending civil registration status, or filing with a foreign authority — because a judgment alone does not show that the case has concluded. Request it together with the certified copy of the judgment so both can be legalised in a single round.
